  • Goff v. Wiley

    [Print This Page]

Due to the extreme public interest in the blog posts concerning the latest lawsuit involving RSU and Joe Wiley, I have decided to create one page wherein all of the information can be synthesized.

    The Case

Marilyn McClain Goff v. Sheree L. Hukill, individually, Dr. Joe A. Wiley, individually, and Rogers State University Board of Regents [The University of Oklahoma Regents]

Original Case: Rogers County CJ-2008-31 (removed to federal court by RSU’s application)

Federal Case: United States Court for the Northern District of Oklahoma 08-CV-71-TCK-FHM

    The Players

Marilyn McClain Goff: The Plaintiff. Alleges she was wrongfully terminated from her position at RSU after 15 years of service. Goff is represented by Brendan McHugh.

Sheree Hukill: A Defendant. Goff’s immediate supervisor. Has since resigned her position at RSU.

Joe Wiley: A Defendant. President of RSU. Was announced as next president of Freed-Hardeman University just days before this lawsuit was filed.

Rogers State University Board of Regents: A Defendant. There is technically no entity with the name “Rogers State University Board of Regents;” however, Rogers State University (along with OU and Cameron University) is governed by the University of Oklahoma Board of Regents.

Hukill, Wiley, and RSU (OU) are represented by University of Oklahoma legal counsel, though Hukill and Wiley were both sued in their individual capacities. Shawnae Robey has done most of OU’s work in this matter.

    Info

The court action was originally filed in Rogers County District Court. It was automatically assigned to Judge Dynda Post. Upon motion from Hukill, Wiley, and RSU’s attorneys, the case was removed to federal court and is now being heard in the U.S. District Court for the Northern District of Oklahoma in Tulsa. In recent cases, RSU has fared much better in federal court than in the district court, so it was not surprising to many observers when RSU asked to move the case to federal court. The federal case is presided over by Judge Terence Kern.

    Documents

The federal courts have very good access to court filings through the PACER system. However, there is a charge of $.08 per page for court records. If you have to look up many things, the costs can add up. As I am going to pull the documents, I am more than happy to provide them to you here at no charge.

Plaintiff’s (Goff’s) filings in blue. Defendants’ (Hukill’s, Wiley’s, and RSU’s) filings in green. Court orders, opinions, and decisions in red. Items stricken through have been stricken by the judge’s order. Click the [PDF] link for document on file with the federal court.
