Judge: Wiley’s Previous Evasion of Service Not Pertinent in Current Case

Just discovered via the PACER system that Judge Kern of the Federal Court in Tulsa has granted Sheree Hukill and Joe Wiley’s motion to strike two attachments to one of Marilyn Goff’s filings. The two exhibits are related to a previous bit of litigation involving RSU. Yours truly was the special process server in that case, and the first exhibit was my affidavit from that case. I swore when I executed it and I swear now that everything in it is true. I kept meticulous notes through the ordeal, and I very carefully recreated the entire experience.

I am now a licensed process server, and I will just say this: no one I have served since that time has more flagrantly and blatantly evaded service of process like Joe Wiley, Jan Carroll, Debra Hedrick, and Becky Noah at RSU. Some of the other defendants also evaded, they just weren’t as good at it. And others of them were decent people and accepted service like grown up adult people living in an orderly society. Additionally, I was not alone most of the time I was attempting service, and I can provide witnesses to corroborate my story.

Unfortunately, Judge Kern has ruled that the information about Defendant Wiley’s previous behavior in regards to service of process is unrelated to the case at hand. I disagree, but he’s the judge. We’ll see where the case goes from here. I think a lot of it will hinge on just what the audit report from the Department of Education says when (if?) it is finally released to the public.

    About the audit report from the U.S. Department of Education — where has the Claremore Progress newspaper been on this whole story? It is pretty sad when we can’t get news out of the local newspaper. Is the Claremore Progress just ignoring stories like this that have to do with RSU? Doesn’t the paper have investigative reporters to research — like when the RSU comptroller sued and said that false travel vouchers were being funded there? Only bloggers told us when RSU finally settled with those students they treated so bad — I want to know just how much of our tax maney the school is shelling out over all this legal stuff. The newspaper never wrote about all the wierd things in that case — like the shuffling around of the appeal board or the erasures of the school’s tapes –and what about all the harsh stuff the judge said about the RSU group when he ruled in favor of the student? Where were the reporters when all that was going on? Isn’t it important for those of us who send our children to this school to know this stuff?

    I haven’t been on your blog before but I can tell you the only reason we sent our kid to RSU was because of the TRiO Programs. The administration kicked that in the teeth. The people in the programs can’t do what the grant calls for them to do because of interference from higher levels. Whether these people do this maliciously or out of ignorance is not mine to know but, for me and mine. I don’t want my kid involved in this. Larry Rice, eat my dust.

    In political jargon, the term “useful idiot” was used to describe Soviet sympathizers in western countries. The implication was that the person in question was naïve, foolish, or in willful denial, and was being cynically used. Useful idiots are paid a bit of money, flattered a little, given authority and told what to do.

    The term is now used more broadly to describe someone who is perceived to be manipulated by a political movement, terrorist group, or hostile college administration.
