Joe Wiley Lawsuit Update

With all the other news lately, I have not updated WynnBlog readers about the latest lawsuit naming Joe Wiley as a defendant.

As you may recall, Marilyn Goff filed suit against Sheree Hukill, Dr. Joe Wiley, and the RSU Board of Regents alleging wrongful termination. (For the record, there is no such entity as the “RSU Board of Regents.” RSU is governed by the O.U. Regents.)

Upon the application of the defendants (Hukill, Wiley, and O.U. Regents), the case has been moved from the county court (Rogers County District Court) to the federal courts (U.S. Courts for the Northern District of Oklahoma). Further, defendants filed a motion Feb. 21, 2008, asking the court to dismiss the case for several reasons, the first of which is improper service. Big surprise.

Anyway, I will have more to say about this later, but I wanted to update readers who have an interest in the case.

    The Bit By Bit program is still up and running. They have had transitions this year but all have been for the positive. The new director is Dr. Velinda Baker. They do such a good job with these children and their families.

    Anyone know who lives in that beautiful log home on the Bit-by-Bit property? Does that person provide general oversight of the Bit by Bit program, is he the gardener or what? What are his job responsibilities and does he make a salary or does he just get free housing?

    I did a little research. According to the Dec. 05 OU Regents’ minutes, Pres. Wiley requested permission to purchase additional acreage for RSU’s Bit -by-bit horse program which included a metal building with living quarters. He reasoned that “by obtaining this property, the institution will not have to build a caretaker house and can eliminate one storage building from its master construction plan.

    My question: So why did they build that huge new log home when Wiley’s reasoning was that they wouldn’t have to build a caretaker house?

    According to the 12/05 OU Regents Minutes:
    ACQUISITION OF PROPERTY – RSU
    The University has the opportunity to acquire approximately 2.97 acres of land next to University property for the new Equestrian Center. This land has existing structures located on it that can be used immediately for the Equestrian Center. The primary structure is a metal building, approximately 40′ x 60′. It has space for storage of equipment and tractors, and has living quarters of approximately 900 square feet to accommodate a caretaker living onsite. By obtaining this property, the institution will not have to build a caretaker house and can eliminate one storage building from its master construction plan .
    The Board of Regents policy 4.13 requires the Board to approve the acquisition of all real property as required to satisfy the mission of the University.
    The University administration has followed the guidelines of the Board of Regents in determining that the property is needed for future expansion, protecting and securing the perimeter of University property, is contiguous to existing University property, and will be used in conjunction with the new Equestrian Center.
    President Wiley recommended the Board of Regents:
    Authorize President Wiley to acquire a tract of land approximately 2.97 acres, and a metal building containing a shop and apartment in Rogers County,…
    Authorize the President or his designee to obtain independent appraisals on the property with the understanding the University’s share of the purchase price will not exceed the independent appraisal or average of the appraisals;
    Authorize the President or his designee to accept private moneys to pay for any difference between the appraisals and the purchase price;

    According to a Claremore Progress article March 10, 2007 “The new [Bit-by-Bit] center also has a resident facility caregiver, Tommy Wiley.”

    I’m just curious about that really nice looking log home – is that the caretaker’s residence? It sure doesn’t look like the “a metal building with [900 square foot]living quarters” a purchase that was supposed to save money by eliminating the need for building a caretaker house.

    If that log home is the caretaker’s residence, exactly what does he do in his caretaker’s position,what does he get paid (this should be public knowledge since it is state funds, right?)and what benefits come with the job? I expect that it comes with free housing?

    Rumors abound that a new VP has been announced but, nothing formal as of now. The new “man” will start in September. Joe Wiley left a mess here. He let Sheree Hukill do as she pleased. He could have not cared less about students involved in the TRiO Programs. The bickering women, the petty feuds, the tattling little nits were not his concern.

    Prediction: The Department of Education was asked to investigate the situation in the TRiO Department at RSU. There was enough evidence of wrong-doing that the Deputy Chief of Higher Education and his staff came personally and stayed a full week. When they left, they made it clear there were negative findings. When they presented their report to Joe Wiley and Larry Rice, people dropped off like flies. Sheree Hukill was given 2 weeks to write the response as to how to “clean up” the mess or how to “dispose” of the “problems” and, so, in her bitterness and in tragic vindication, she responded in a way that took the programs down. Joe Wiley could not care less. He let her response speak for the University. How many hundreds of thousands? Millions? of dollars have been lost because of this? If it were not for the law suits and charges being investigated, we would already know. Shame on you Joe Wiley. Shame on you.
    If Larry Rice does not do something positive about this to amend the situation with the Department of Ed, then, shame on him as well. The woman he put in as interim appears to be an honest person but has no knowledge of the true nature of TRiO programs and has little desire to know. She appears to be an honest person but quickly fell into the notion that she should “hold the fort” and keep the “status-quo” that Sheree Hukill had set in place. Why should she not? As far as she knew, Sheree was doing Gods work and Wiley certainly told her no different. What Hath God Wrought?

    Marilyn Goff entered into mediation with RSU. Tom Volturo is running the show. It did not go well. Surprise, Surprise, Surprise. The Wiley/Volturo/RSU team has firmly stood their ground and defended their well earned reputation for nastiness, lack of regard for civil rights, arrogance, and bullying. I am aware of the writing on this blog concerning the investigations of the Department of Ed. There is a strong line of truth here. Perhaps the Office of the Inspector General could help? As someone has suggested before…Does anyone care? It’s only your tax dollars and it’s only our comunity, and it’s only our school, and it’s only right? Does anyone care?

    Tom Volturo and Joe Wiley are not working individually. They are a team. I’d like to know more about this Tom Volturo person and where he came from. What is his background and how many of these scandals has he “puppet mastered?”

    Is anyone going to look into this? I’ve seen 3 cases now where Volturo is the guiding force. Folks, this vulture is still going to be with us…even when the doorknob catches Wiley in the rear! What is up with this? How many of our tax dollars have been spent on their mowing “machine” Marilyn Goff’s case is just downright pure evil and these guys need to be cured of this stuff in some way.

    You ask, “I’d like to know more about this Tom Volturo person and where he came from. What is his background…” Previous to working at RSU, Tom Volturo apparantly worked as an auditor in the state auditor’s office – perhaps he and Joe Wiley became friends when Volturo helped investigate Southeastern Ok State Univ. in Durant. Just go into the archived articles of the Daily Oklahoman and read the articles about when the state and Feds were investigating SEOSU. This investigation revealed accusations against Mr. Hibbs, SEOSU’s president, of extensive mismanagement/embezzlement of funds and using his family members to funnel a lot of the university funds into his own pockets (Hibbs was convicted). The news articles that describe the creative methods by which state money made its way into Hibbs personal use is fascinating reading, it involved insurance scams, student aid falsification and redirection of that money, the hiring of family members and computer purchases from Hibbs’ son’s computer business as well as others.

    I believe Wiley was director of the computer department at SEOSU at that time. A few years ago, allegations were made by RSU’s x-comptroller, Mr. Parris, against Volturo and Wiley (allegations of falsification of documents to cover illegal travel vouchers) but the lawsuit was dismissed based on the Judge’s determination that the Whistleblower Act did not protect University employees, so the allegations were not pursued.

    You think Marilyn Goff’s case is just downright pure evil and these guys need to be cured of this stuff and you want help?

    There is an avenue that can be pursued. It is a Grand Jury investigation. Her case is just one of several at RSU over the past few years.

    Also, more than just the TRIO people have complained about having no control over their own budgets and grant money, — complaints that they were required to obtain state and federal grants for their department, but then never saw how it was allocated. Talk to the previous director of the distance learning dept., the fellow who headed up the RSU Bartlesville branch, or the previous director of the RSU radio. Interestingly they no longer work there.

    I think the administration’s control of the grant money is highly unusual, but even more unusual is the repeated complaint that Wiley required so many people who left the employment at RSU to sign confidentiality statements – many of these people worked in financial areas. These people were intimidated and still maintain secrecy today because of concern about legal ramifications if they violate their “confidentiality” agreement. I do not see how this is legal, yet….??

    A lot of questions have been raised and a lot of people have been hurt over the last few years and there is still a lot of fear of retaliation even though Wiley will be leaving.

    RSU’s presence in this community is highly political. Stratton Taylor, (the previous Senate pro-tem) – his wife works at RSU in the admin building. If I’m not mistaken, I believe that his partner, Burrage (also a Rogers Co politician) – his wife also works there. So complaining to the legislature is probably not going to accomplish much. Since the State Auditor’s office has come into disrepute with the recent conviction of one there, I doubt that going there would be much help. You could try going the State Regents, but I know that has been tried too without results. Lawsuits just get settled and no one is the wiser.

    I believe our community deserves a Grand Jury investigation into the financial dealings at RSU – a much broader investigation than just the TRIO dept. Even if this new president is great, we need to know about the past and get it rectified. We all deserve answers. Things should not be swept under the rug in hopes that we are in for better times. But the community, particularly those who work at RSU, have to care enough to go for it. So far, many of the people at RSU have been intimidated or more concerned about their own job security, in spite of seeing wrongs. A Grand Jury investigation would protect those people who would be willing to talk. Until people are willing to come forward and risk their own personal comfort though, all will go on as usual and no one will be held accountable.

    Getting a Grand Jury investigation can be initiated by individuals – a certain number of signatures are required on a petition. It is an avenue for individuals who suspect high-level corruption. A lot of people may be willing to come forward and tell their story if they have this kind of protection.

    Okay, you said to ask questions. I have a few: Is anyone employed there related to Joe Wiley or any other well-paid state employee from RSU or otherwise? Who is the care-taker at the RSU Bit-by-Bit program, what are their qualifications for the job, what are his/her duties and what is he/she paid from the RSU or Bit-by-Bit budget, (including perks such as house and/or vehicle?)? About how many hours does this person work care-taking the facility and does he/she also happen to also work for a construction firm that gets state contracts? Also, who is living in the new log cabin on that facility grounds?

    Has any horse that was heavily insured died mysteriously? (I think I remember reading an article regarding the Hibbs investigation at SEOSU in Durant where that was reported to have happened.)

    I would sure like to know what Mr. Volturo and Mr. Joe Wiley have to say about what the old RSU comptroller (Mr. Paris) accused them of doing. All that stuff about getting illegal travel vouchers and changing the documents and all. It seems to me that when a person in a taxpayer-funded job who has a hold on the money bags gets accused of financial fraud, then the accused person ought to have to give an answer to the tax payers and someone ought to investigate and see if it is true.

    As we understand it, Volturo has been behind settlement negotiations in each and every case since Wiley took control here. Folks, more than one person is afraid to say a word about any of this. “Things” happen to people. Ask Hibbs, ask Paris, Pam, Brock, Fellman, Lawless, Jan, Goff, go ahead, if you can find them…ask..but, they won’t talk. As long as Volturo is there, they won’t talk. Is Mark Meaders someone trustworthy? Who knows…he’s under Volturo.

    Wiley is never the hands on guy. Volturo does the “paper work” Wiley is the mouth. This stinks big, big time. There are things in the Financial Aid office that smell to high heaven. We have tried to trigger an investigation but somebody, somewhere has “blocked” every attempt. Boren? Volturo? seems to be higher somewhere…not sure… I don’t think we know the half of it. One half we do know has to do with Volturo.

    This week we heard a rumor that Jim Finley was contacted about the possibility of taking over the reins of the Executive Director of TRiO position. Anyone else hear that? If he does, he knows where the skeletons are buried, however, not sure what he would do with the Volturo situation. One thing is sure, there are some women in that office that have bad cases of gossip, back-stabbing and down right nasty little close minded crapola. Every document, every phone call, every conversation goes through Rhonda Cox and Rennah Robinson. It’s their party and it’s their friends. If the department of ed defunds these grants, Rhonda, Rennah, Dorothy, Elizabeth…all of you are going to be in the same boat as the rest of us…shoeleather on the street lookin for a hand up and a hand out. Keep it up ladies. see who else you can run off. Read the report and weep. Just because you have played your little minor role of “under dog” for Dr. Schoenefeld and for Linda Andrews and oh, poor you, poor you! Go lay down and let your pups suck why don’t you! Your petty little sniffing and pouting and piousness is nothing short of pitiful. We could be working together to try to save the programs. No, you’d rather get rid of people you know very little about whose efforts and investments in this thing you couldn’t hold a candle to. Stop the petty undermining and try to help us why don’t you? Maybe if Jim comes back he can help since he does know now at least who can be trusted.

    With all the gossip and running to the VP office to complain every time someone gets their little feelers hurt…no wonder the administration is sick of them. Dorothy Mullis says she is so hurt because she has been passed over so many times for promotion. Rennah and Rhonda believe it is so wrong that people with “degrees” get to do all the “fun” stuff and they have to do all the work. How sad for all of you. Keep whining and keep running up the hall and see how long anyone wants to put up with you. It looks like you have pretty much done it all in already. Isn’t there something of a higher nature that you ladies could contribute to this situation or are you just such “useful idiots” that you can’t get past your own little petty selves? Ask Velva Agee, ask Jim Finley, ask anyone who has been in positions of leadership how difficult it is do get anything past these “watch dogs” as someone earlier so aptly phrased it. Very good, very good analogy! We have been seeing suggestions posted here for some time that people try to come together and pull the programs out of the frying pan.     Although Jim Finley has retired, people come out of retirement all the time. Don’t forget Wiley supposedly “retired” also, and Jim has a wife with her own agenda who would obviously support such a decision. It’s also true that Wiley enjoys wide-spread bipartisan protection. Of the seven findings in the DOE report, in a letter dated June 6, 2007, I informed Wiley as well as the governor, both U.S. senators, Congressman Boren, and the state regents about three of them and about the hostile work environment, as well as warning that this behavior would only result in more litigation and liability on the part of the university. I also wrote Oklahoma’s attorney general, but apparently “corruption” is out of the scope of his office. Wiley’s cartel also seems to have the Tulsa World, the Claremore Progress, the Post Master, at least one judge, and local law enforcement officials covering his backside too. From all accounts, Wiley is untouchable and above the law. It is an outrage and chances are we’ll never see justice. Lots of folks care, but this is one we may have to leave to a higher power. The good news is that what goes around really does come around. Just ask Sheree Hukill and Penny Pricer. Without a doubt the evil doers will get theirs, but we probably won’t get to see it. Oh, by the way, does anybody know how one goes about getting into The Good Old Boys Club of Oklahoma?

    Higher Ed officials influence millions of dollars and hold positions of strategic authority. For instance, the State of Oklahoma Council of Bond Oversight is a 5-member board responsible for the approval of all borrowings (millions of dollars) by state agencies — highway projects to higher ed funding. Look at some of the previous appointments to this board: Joe Wiley, (RSU Pres.), Pam Williams (wife of NSU Pres.,) Claudia San Pedro (had worked for the State Regents of Higher Ed). Tom Volturo of RSU is a member of the OK Accountancy Board which oversees licensed accountants and CPA’s. Joe Wiley was also one of three members on the Claremore Ethics Board.

    Though prominent Higher Ed officials have a great deal of influence on strategic committees that impact their own industry, oversight of Higher Ed is limited.     If I had concerns, I would not expect results from most state officials; I know that complaints have been made to the Governor, the Board of Regents, the office of the State Auditor, and other local and state politicians but I’ve never seen any results. If you or others have serious financial concerns, start a list of names and departments. Once you have a list of names of individuals who would be willing to give evidence, I would contact multiple federal investigative departments and consider initiating a grand jury investigation, always keeping master copies of all documents that come into your possession. Documentation should include a condensed version of concerns, including times, dates, names and events and should not include personal feelings.     OK Try this again…The red-head still works in TRiO. The man girl is a former TRiO Department employee who works at TCC. They have no idea what they are dealing with. The Dept has had it. The word on the “street” is that the ladies better keep on tanning and having their nails done since there won’t be any jobs down there at all in less than 6 months. Go on ladies…keep fighting on the wrong side. Maybe your tan will help you get a job elsewhere. You won’t find a job where you’ll be able to take your GED or your high school diploma and get a job where you can control $8.M…Maybe you can go get a job with Wiley, if you are Church of Christ.

    If Stratton Taylor has any smarts at all or any integrity for that matter, he will help Rice clean this mess up…all the messes. Not bloody likely though. It will take Rice a long time…at best!

    We have asked questions and we hear that Wiley’s son kept dogs in that beautiful mountain lodge home the University paid for. The dogs have torn the place up and trashed the whole thing. Is there anyway to get that guy out of there? This is outright criminal. People are sick and tired of being scared, intimidated, and threatened. What kind of politician is this sorry Stratton Taylor that would be part of this crapola to put a person like JOe Wiley in here? I’m not from Claremore but..who would want to be. If you people have been living with this so long…you know the deal…you get the kind of government you deserve. This is just sickening. I’m sick of all of it.

Read the report…47% of the staff run off in 2 years…There is more than one bad actor in that basement of preparatory hall. There are major players and there are, as they say, “useful idiots” It doesn’t matter. The facts are, the TRiO Programs do serve a great need. They have caused problems because they have been mismanaged. If you will pay attention to the DOE Report and let us help you and support you. We will show you where the snakes are. You have to have faith. We know you are under a great deal of pressure right now and there are many of praying for you. Please don’t give up on TRiO. Please understand that Sara Schoenefeld is not helping you, she is hurting us right now. She is mislead and it’s getting worse. Please keep the faith. We know your personal concerns and we know your heart is hurting. We are with you and will be faithful. Joe Wiley has left you with a mess and Volturo will not help you. Pray for wisdom, pray for guidance. Don’t give up on good people. The Lord wil show you the right way. We are hopeful about Toby. It will take a while but we are with you. Please don’t give up on TRiO.

    It’s not that big a mess. It can be straightened out. Just let the Program Directors manage their grants as specified in the grant. Move the secretaries out of positions that allow them to make decisions about money, purchases, travel, hiring and personnel. That’s what they do now…The Directors, people that are legally responsible, have had their authority undermined and usurped. TRiO is not the only department at RSU where this has happened. It’s a shame. People are hurting and people are afraid. Until the people who are legally responsible are given back their authority, it’ll continue to get worse.

    Where is Marilyn Goff and why is she not back at work? Marilyn Goff, Mike Hogan, Jim Finley, Velva Agee, and even Jody Collier could clean that joint up in a heart beat if given half a chance. What is the deal? Looks like this crazy, one horse (one dead horse?). The administration doesn’t care how much they are sued. They probably have 8 million in law suit insurance…they don’t give a ratts patoo who sues them. They have good insurance. Wiley has put it to good use and it’s served them well. Until it hurts Wiley, ya’ll can just whistle past the grave yard…or hope the Vulture man don’t git ya.
